Another Reason for "Castle Doctrine"

A few days ago I posted about how Castle Doctrin was coming to Texas. That's the "stand your ground" legislation that says that you don't have an obligation to run away from your attackers. In response to that, I received an email from a gentleman (who wishes to remain anonymous) who provides another good reason for it:

I do believe in retreating from a threat as an alternative to exercising lethal force. Using lethal force, any rational person can see, can have seriously encumbering consequences that could dominate one for years.

Still, I have reservations about retreat being my only legal alternative. The greatest is occasioned by my inability to yield ground. We are both in our late 60s and live in a shooting-plagued neighborhood of a dangerous city. We both need canes. Neither of us can run. Literally, we cannot run.

It seems to me that this is an issue coming into its own because of demographics. As the proportion of people our age grows, so grow the numbers of people who are physically incapable of flight. This is a particularly compelling reason, I think, for allowing people to defend themselves.

Compelling, indeed!

A reasonable person with a cane would not flee, due to inability. To me, this is a lame argument.

Having said that, I fully support the law. The thought of a grand jury second guessing my actions, and what is "reasonable" in a life or death situation scares the excrement out of me.

I agree with Leo, having someone with the ability to look back at the situation with weeks and months to look into every possible senario should not be afford the same right to decide whether or not i was in a life or death situation, when i had only a few seconds to decide. To me, there is just no comparison.

Hi Jeff,

I just wanted to draw your attention to what seems (at least in my eyes) to be an issue in the current discussion of Castle Doctrine. I have a post about it here:

I'd be interested to hear your thoughts.

the comment input form disappears.

Your comments are welcome. You don't need to enter a URL and you don't need a "valid" email address, either. Note though that MT Blacklist is installed to flag suspiciously spam-like strings. Unfortunately, because of the bastard spammers, the strings "google.com" and "yahoo.com" (even in your email address) are currently banned as well. So are strings such as "cialis" (a common spam) which rules out words such as "socialism". Try putting a hyphan in a word like that.
