Wheelchair Bound Woman Shoots Attacker

And, brace yourself, the story makes the New York Times(!):


As muggings go, it began like many others. A 56-year-old woman was leaving her building in her wheelchair, her only company the small dog perched on her lap.

Her attacker came from behind, the police said, and there was no one else around. But this attempted robbery had an ending unlike many others. As it turns out, the would-be victim, Margaret Johnson, has a permit to carry a .357 handgun — and she carries it often.

The mugging ended seconds after it began, the police said, when Ms. Johnson pulled out her gun and shot her attacker in his arm. Last night, the man accused of the attempted mugging, Deron Johnson, 45, was in stable condition at Harlem Hospital Center with a gunshot wound to his elbow, the police said. He was under protective custody and is facing a robbery charge, the police said.

Ms. Johnson, who was treated at a local hospital and later released, said she suffered bruises to her neck and arm. “I’m tired, I’m really tired,” she said as she sat in her apartment last night, wearing a tan baseball cap and appearing rattled. “He tried to mug me, so I shot him.”


Not only that, the NYC cops (much to their dismay) can't prosecute her because she had a permit and was carrying it to the range. NYC Mayor Michael Blowhard must be inconsolable about now...

The optimist in me thinks this might be one of those "eureka" moments when something seemingly glaringly obvious finally catches on.

The pessimist in me thinks, no.

Good for Ms. Johnson. She sounds like a great lady.

She could still be arrested for not having a handgun license have her gun taken away and go to jail because NY City only issues a "Premise License" and according the the NY City Police Department: "... a premise license issued by the New York City Police Department is limited as to place of possession, and therefore would not be valid outside the licensed premises. ... A licensee may transport his licensed handgun unloaded, in a locked container with the ammunition carried separately while traveling to or from an authorized range or shooting club in New York City.

This is because in the past, under a NY Court ruling, the police could not arrest someone with a handgun on the street if they were "carring concealed" because they still had a license, the person was just ignoring the restrictions placed on the license so the worse that could happen was that the license was revolked. In 2002 they stopped issuing handgun "target" licenses under PL 400 Section F and only issues "Premise Licenses" under PL 400 Section A & B. Now, if someone has a loaded handgun outside their "Premise" their license is no longer valid so they can be arrested for having a handgun without a license. It does not look like she had the handgun "in a locked container with the ammunition carried separately" and I do not know but I do not think that she is within "wheelchair" distance of any ranges in NY City. And the quote from the article, " — and she carries it often." makes it sound like she was not on the way to the range.

Good catch. This is a point I've brought up on a couple of blogs.

My imaginary vision of the Cop taking her report:

Mrs. Johnson: "I was on my way to the corner store when..."

Cop: "Um...excuse me Ma'am...You had a .357 Magnum on your person on the way to the corner store? Do you have a permit to carry a concealed weapon?

Mrs. Johnson: "Well....no."

Cop: "In that case...don't you mean you were on your way to the shooting range?"

Mrs. Johnson (with a look of dawning comprehension on her face): "Why yes, Officer, I WAS on my way to the range. Thank you for reminding me..."


The DA and Nanny Mike are letting it go because they don't want to be remembered as the a$$es that jailed "the wheelchair granny" for defending herself. Especially not with repercussions from their recent anti-gun "sting" operation still simmering.

With a little luck, they will be remembered as the hypocrites that didn't have enough guts to enforce the law when it would cost them politically, but mounted an illegal campaign out of their jurisdiction to try to commit fraud upon the law abiding retailers in other states who were less sympathetic but just as entitled as Ms. Johnson.
