September 07, 2006NY "Shall Issue"? Fuggetaboutit!Well, allowing law abiding citizens in New York State the right to protect themselves with "shall issue" concealed-carry permits is a nice dream of justice but as the New York Sun and gun control proponents points out, it will never happen:
First of all, the writer of this NY Sun article confuses the issue for readers. State authorities would only be "obliged" to grant licenses to those applicants who meet NY State's rather rigorous requirements which include a federal as well as locally conducted background check, and probably training as well. Crips need not apply. Second, what exactly is "New York Culture"? Gang crime? Perpetual victimhood? It's all a moot point because while the issue would probably pass if you polled only those living in the rural areas of New York, the vast majority of New Yorkers, all of them leftist, liberal effetes living down state would vote against anything like "shall issue" for CCW. For once, unfortunately, I agree with the Brady Bunch spokesman Peter Hamm:
Gang bangers win. Honest citizens lose. Posted by Jeff Soyer at September 7, 2006 07:41 AM Comments
I'll be a NY State resident for a few more months, although I'm stationed in Alaska with the USAF. I want one more shot to vote against Hillary, then I'm becoming a resident of Alaska. When I go home on leave, I can't go to the range with my brother [NYS Trooper] because I don't have a permit. A freakin' permit to fire someone else's gun, and that includes rentals. Viva Alaska. Posted by: JP at September 7, 2006 08:32 AMJP -- Congrats on AK. My oldest son and his family live there. As gun friendly as it gets. Jack. Posted by: Jack Lorenz at September 7, 2006 10:56 AMJeff, for your information the NY state legislature has in the past voted for a full shall issue system including all of New York City. It was vetoed after *one* person in the Dept. of Criminal Justice Services complained. While we are not likely to get shall issue in the immediate future, I can assure you that it is not as unlikely as you think. Posted by: Jacob at September 7, 2006 11:12 AMWhen I filled out the NY handgun permit form, it had a place to list the occasions when you would be carrying. Most people put in hunting, fishing, target shooting, camping. I added hiking and jogging, which came through on the permit. Thus, if I'm wearing sneakers and sweats, or boots and any kind of pack, I'm legal to carry concealed. NY has funny rules; they don't actually say you can carry concealed, but you get liscensed to carry on these occasions, and they have a law against open carry. The only way is House Bill 4547 - National standard for the carrying of certain concealed firearms by nonresidents. We have to make sure this passes. This will be answer. Get a permit from another state and you will be able to carry in New York state. Those of you in free states get your reps to support this bill. Not only for NY but for the rest of the U.S. Posted by: Rich at September 7, 2006 02:58 PMI think a "shall issue" law ought to be proposed EVERY session and anyone against it should be stood up and labeled as the rascist, genocidal, ignorant, un-American, Liberty-hating, Freedom-fearing, Bill of Rights abolishing imbecile that they are. How's that? Posted by: Robert at September 7, 2006 07:11 PM I thought the Second Amendment gave us the power to bear arms aginst liberal tyrants and over come them. We all know that we have a right to bear arms, then why are we negotiating with the enemy. Would you nagotiate with terrorists. These people hate our freedoms and they will never stop. One day they will win, it's only a matter of time. LETS BEAR ARMS! Then we don't have to worry about loosing our freedoms anymore. Personally, I'm tired of every election, not knowing if I need to hide my guns or obey liberals. Lets just get it over with so we can get on with our lives. America is free, you don't like it then leave. The UK has all the gun laws and violent crimes you liberals could ever want. Go there and leave us alone! Posted by: Jeff at September 7, 2006 09:20 PMThe problem is that the liberals are in control of the instruments of state power - the armed cops. And if it's just you against the cops, you will lose every time. They can operate in groups of 5 or 10 prepared to surround and kill you at the slightest indication of resistance, knowing that the state will not prosecute them but will absolutely crucify you if you resist and they don't kill you first. Armed resistance will only work against an armed state when there are sufficient numbers of resisters willing to put their lives, fortunes and sacred honor on the line. Such that the cops know that if they show up in force at your door there's a good chance the guy across the street will start shooting them in the back, and two guys down the street will pick off any survivors as they come out of your house. Until that level of resistance develops, all we can sensibly do is work to change the laws that the armed state enforces against us, and to remove from political power those whose purpose is (intentionally or unintentionally) to do us harm. Even with changed laws we may still face state power which disregards those laws, but at least then we can use another instrument of state power - the courts - against the scofflaws. (The sheriff of Jackson County (Kansas City) is being sued at the moment for his "I don't care what the state law says, my policy is otherwise" attitude regarding Missouri's pistol permit process - we all expect him to learn an expensive lesson once the plaintiff's junkyard-dog lawyer gets through with him.)
