Smart Law in Alaska

I've mentioned before the good laws passed in Colorado and Virginia where local municipalities can't enact stricter gun laws then what state law says. Alaska will now have the same deal. From the LA Times:


Starting Wednesday, handgun owners will be allowed to carry concealed weapons without a permit in the seven Alaska cities where permits are now required.

Gun owners also will be allowed to keep their firearms in their vehicles, even if a car is parked on private property where the owner has a no-gun policy.

Some police chiefs say that local ordinances that ban guns from public buildings such as city halls will no longer be enforceable.

The new law forbids municipalities from passing gun laws that are more restrictive than state law.

The National Rifle Assn., which helped Republican state Rep. Mike Chenault draft the new law, said the organization wanted to prevent cities from passing restrictive laws.

"We are looking to make it uniform to all 50 states," spokeswoman Kelly Hobbs said from the NRA's Fairfax, Va., headquarters. "Without it, it creates an unfair, inconsistent and confusing patchwork of local firearm ordinances."

Chenault said a law-abiding citizen should be able to carry a firearm wherever he wanted to, but in Alaska, that citizen might break the law and not know it.

"You could leave Homer with a gun in your vehicle and find yourself in conflict with laws in other municipalities just by driving through those municipalities," he said.


This is just common sense as -- previously -- a gun owner had to know the specific ordinances of every single city if he did any sort of traveling and if his route took him through a city that banned carry or even having a pistol in his glove compartment, he'd be subject to arrest.

Maybe Illinois needs a bill like this -- that would shake up Mayor Daley!

Update 10/17: Not to nit-pick but the AP has a story today titled, "New Anti-Gun Law Set for Alaska":


Starting Wednesday, handgun owners won't need permits to carry concealed weapons in the seven Alaska cities where they're still required. There also will be no more restrictions on keeping a firearm in a vehicle.

A new state anti-gun control law that goes into effect will essentially bar municipalities from passing gun laws that are more restrictive than state law.


Just for once I'd like to see it phrased as "a gun-rights law". But maybe that's just me...

I don't see why there should be a problem having a gun in the trunk of your car - no matter where you are. I'm not quite as thrilled with the idea of someone having a loaded handgun within hand's reach while they're driving - although I can see the need for personal protection at times. There are a lot of crazy people already on the roads who don't mind using their vehicle as a deadly weapon, and I think it might be better not to give them one more thing to use while they're in the midst of road rage.

As far as guns in the courtrooms, I'd rather not have them there. I can picture too many divorce courts turning ugly really fast.

You have spewed virtually the same argument from the anti-gunners about concealed carry, that say, people would be shooting each other over road rage or fender benders, and none of that has come true.

Remember Brian Nichols? Guy who killed a few people in the courtroom? The police failed to stop him, telling me that I shouldn't solely rely on them when it comes to protecting myself in the courtroom.

Your view about guns in the courtroom seems to think that people are savages incapable of exercising restraint, and the only thing keeping us from slaughtering each other is denying access to guns.

I only have one problem with this:

If a property owner doesn't want guns on their property, they should be able to exclude those people who aren't willing to leave their guns off the property. It's their property and they should be allowed to do as they see fit.

The NRA has been making a big deal about this, saying that gun owners are being denied their rights, but I see it as them trying to impose their wishes on other private entities. Private citizens cannot, by definition, deny others' rights on their own property. If it was guns in the trunk on government (ie, public) property, no, they shouldn't be able to exclude that. But private property owners should. My right to behave in any manner I wish ends where someone else's property begins.

Private property owners should be able to set whatever conditions they want for others wishing to enter their property. If my neighbor says no guns, that's his right. If I say all women wishing to come on my property must do so topless, that's my right, too.
