New Law Firm For NYC Gun Suit...

...To represent NYC in a suit against the gun industry... NYC is planning a lawsuit against the gun manufacturers because leftist-liberal neo-fascist Mayor Bloomberg won't rest until he sucks some money from them. From the New York Times:


A top national law firm is joining New York City's landmark case that claims the firearms industry is responsible for gun crimes, replacing another major firm that stopped representing the city after at least one of its corporate clients complained about its role in the suit.

The entry of the new law firm for the city, Thelen Reid & Priest, is to be made in a court filing today, city lawyers said yesterday. Thelen Reid, like the city's prior legal ally, Weil, Gotshal & Manges, agreed to work on the case at no charge.

The lawyer who is to head Thelen Reid's trial team, Michael S. Elkin, said yesterday that one reason for the decision to help the city was his firm's support for public interest legal efforts aimed at preventing gun violence.

That commitment, he said, began with 10 partners from its West Coast offices who worked at Petit & Martin, a San Francisco law firm where a gunman opened fire in a 1993 shooting spree that killed eight people and wounded six others.


My first thought is, "Why don't they sue the mutant that actually criminally misused a gun to shoot those people?" The fact is that it wasn't the CEO of Glock or S&W or any other gun firm that went on a shooting spree; it was some criminally demented piece of crap. But of course that piece of crap doesn't have any money so... And let's face it, while the law firm claims it doesn't want any fee for handling the case, you can bet they will subtract "expenses" from any settlement. Phone time: $5.00 per minute, Photocopies: $2.00 each... Et cetera.

The case is scheduled to be heard in Brooklyn in by Judge Jack B. Weinstein, the same judge who threw-out the last suit (filed by the NAACP and written about extensively here at Alphecca) on a technicality. At that time, he stated that he would be open to further gun maker suits. In my First Amendment protected opinion, Weinstein has shown a clear anti-gun bias over his years presiding on the bench and is unfit to hear this case. That is why the City is so anxious for him to hear theirs...

This is another example of a greedy city desiring lots of money and deciding to sue gun makers for the misuse of their products by mutant criminals. Since anyone legally purchasing a firearm must go through background checks (and in NYC a whole lot more) and since most gun makers don't sell directly to the public but instead through distributors and gun dealers, it's hard to see how THEY could be held liable for the criminal actions of others.

Should Ford or BMW be held liable for the misuse of their cars driven by drunks, car-stealers, and other law-breakers? Of course not, and they aren't. But the leftist-liberals and their trial-lawyer buddies refuse to blame the criminal; it must be the fault of the product and its maker!

In fairness to the New York Times, this story (read the whole thing) was actually rather balanced and had plenty of quotes from opponents of the suit.

I might add that I'm going to be covering some of these stories over the coming days because my work schedule precludes a "Weekly Check" next monday -- meaning there won't be one...

When is some gun manufacturer going to find the fortitude to respond to one of these suits with a product safety recall of that particular production run purchased by the suing municipality's police department and decline to replace them?

Triticale, that's an interesting idea. Kinda sorta like the doctors who refuse to treat medical malpractice lawyers.

ok, not really, but it has the same poetic justice.

My own thought was, if I get mugged by someone originally from New York, can I sue NYC for exporting its thugs?

Your comments are welcome. You don't need to enter a URL and you don't need a "valid" email address, either. Note though that MT Blacklist is installed to flag suspiciously spam-like strings. Unfortunately, because of the bastard spammers, the strings "google.com" and "yahoo.com" (even in your email address) are currently banned as well. So are strings such as "cialis" (a common spam) which rules out words such as "socialism". Try putting a hyphan in a word like that.
