Philadelphia Mayor to Disobey Law
Rather than go after criminals, the Philadelphia Mayor and City Council have decided to become criminals themselves. From the Philadelphia Inquirer:
Mayor Nutter yesterday said he would enforce new city gun-control laws even without state authorization to do so - setting up a possible legal and political showdown between the state and the new mayor.
At the first regular meeting of the new City Council yesterday, Council members Darrell L. Clarke and Donna Reed Miller introduced the same package of gun-control measures that languished last year while the state legislature refused to authorize them.
But these bills have a new wrinkle - they don’t call for state-enabling legislation. The previous bills were conditional on companion state laws in recognition of a 1996 Pennsylvania Supreme Court ruling that said cities could not enforce their own gun laws.
But Nutter, Clarke and Miller, frustrated by the repeated failure of gun-control measures in the legislature, now appear ready to do just that.
“If these bills pass and if I sign them, then I expect to enforce them,” Nutter said.
[…]
The bills would force owners to immediately report stolen guns; set monthly limits for firearms purchases; require vendors to report ammunition sales; and prohibit gun sales to anyone who is the subject of an order of protection.
So if you’re on vacation and your guns are stolen, you could be arrested. And forget about bidding on that pair of dueling pistols at auction. . . .
Once again, it’s “punish the law abiding gun owners” rather than the criminals and if that means violating the Pennsylvania Constitution or state law, so be it.
This seems to be a common thread of late where activist mayors around the country violate their states’ laws, such as “marrying” same sex couples or passing (in SF) gun bans. Apparently the only laws they want to obey are the ones they pass themselves!

Can the City Council be arrested for violating state law in this respect?

Well we all know philly is corrupt we have known this for years. The democrats have been supporting the crime down there for years and the cops don’t do shit expect play with themselves. This is not something new that we’re learning but let them try to take away the people’s rights those stupid monkeys I hope the NRA eats them alive, fucks their day up,and basically shoot them down just like every other democrat.
I really hate democrats and philly needs to start all over if you get the drift.

Someone that lives in that city should file a lawsuit now to keep the law from being enforced.

Somebody should (steal) take all the guns from the Mayor, elected officials - - and see if they report them as lost …
(heh, couldn’t resist)

One grows weary of these Burgermeister Meisterburger types.

Please remember that one of Nutter’s other proposals is to institute a program of stopping, questioning and searching people who are walking in public. Nutter believes that his endless crime emergency declaration allows for him to permanently bypass 4th Amendment protections against unlawful searches by the police. This guy is downright dangerous.

On Friday Chris Matthews said he thinks “they ought to check people on sidewalks like they do getting on airplanes.”
Matthews and this Nutter seem to be on the same page.

I’m not particularly worried about this particular bit of political theater.
The PA state supreme court spanked them profoundly for trying this nonsense in the 90’s.
They’ll be happy to read them the riot act again.

I’m sure they will, but it doesn’t appear to have done much good the first time.

I don’t really care about the city council getting the smack-down as much as I’d like to see them do some jail time.
